Filing a Formal Complaint

WHO CAN FILE A FORMAL COMPLAINT

A University student, employee, organization, department or visitor who believes they are a victim of a student’s misconduct (hereinafter “complainant”) may make a charge, accusation, or allegation against a student (hereinafter “respondent”) which if proved, may subject the respondent to disciplinary action. 

Please note: 

  • Cases of assault, theft, harassment and other serious or immediate issues should be reported to CCNY Public Safety in NAC 3/201, 212-650-6911 immediately.
  • Academic Integrity Violations must be reported to the Office of Academic Standards.

FOR COMPLAINTS FROM FACULTY & STAFF:

  • Complainant's name and phone number
  • Nature and date of alleged violation/behavior
  • Name of person(s)/organization responsible for the alleged violation/behavior
  • Detailed statement of the incident
  • The best time to contact you for more information if needed.

If the complaint is regarding a faculty member, students should follow this procedure. Students are encouraged to attempt to resolve complaints informally with the faculty member or to seek the assistance of the department chairperson or campus ombudsman to facilitate informal resolution.

ONCE A COMPLAINT IS FILED

After receiving a formal complaint against a student, the Office of Student Conduct and Community Standards will contact the complainant confirming receipt of the complaint and conduct a preliminary investigation in order to determine whether disciplinary charges should be preferred. The Office of Student Conduct and Community Standards shall advise the respondent of the allegation against them, explain to the respondent and the complainant their rights, consult with other parties who may be involved or who have information regarding the incident, and review other relevant evidence.

Following the completion of the investigation, the Office of Student Conduct and Community Standards shall take one of the following actions:

1. Dismiss the matter if there is no basis for the allegation(s) or the allegation(s) does not      warrant disciplinary action. The individuals involved shall be notified that the complaint has been dismissed;

2. Refer the matter to mediation (except in cases involving allegations of sexual assault, stalking or other forms of sexual violence); or

3. Prefer formal disciplinary charges.

In certain cases when the accuser decides not to file or pursue a formal complaint, the University reserves the right to continue to process the matter.
